DAVID M. NIEPORENT

David Nieporent, a founding partner of STEIN & NIEPORENT LLP, graduated from Princeton University and St. John's University School of Law, where he was a St. Thomas More Scholar and a member of the Law Review. While at Princeton, David was a national semifinalist in the annual collegiate Jeopardy! tournament. He has extensive litigation and transactional experience. Mr. Nieporent has acquired expertise in both prosecuting and defending wage-and-hour cases under the Fair Labor Standards Act (“FLSA”) and state labor laws, and, along with his partner, David Stein, successfully has tried several federal wage-and-hour cases to verdict. He has extensive experience with employment litigation, and he counsels employers on employment law compliance. Currently, David is intimately involved in many class action cases pending in the federal district courts of New York and New Jersey involving allegations of overtime and minimum wage violations. 


Mr. Nieporent also is fluent in matters pertaining to the Internet, including vetting websites for intellectual property issues, advising website owners on regulatory, compliance (including Americans with Disabilities Act), and protection issues necessary for the operation of Web-based enterprises, and providing website operators with "soup to nuts" legal advice pertaining to privacy policies, terms of use, IP clearance, and other Internet forms and procedures.


Earlier in his professional career, David practiced general commercial litigation and represented Web-based independent distributors in disputes with companies seeking to restrict consumers' ability to purchase legitimate merchandise on the Internet by threatening litigation under spurious trademark and copyright theories.


Mr. Nieporent is admitted to practice in the federal and state courts of New York and New Jersey and in the federal court of the Eastern District of Michigan.


DAVID STEIN

David Stein, the lead attorney in more than 400 federal cases, is a distinguished litigator recognized for his tough-as-nails advocacy on behalf of his clients. With more than 30 years of experience, he has a long record of successful litigation in both civil and criminal matters. In the field of employment law, representing employers and employees in lawsuits and investigations involving claims for overtime and minimum wage violations. Mr. Stein has tried several federal wage-and-hour cases to verdict and has served as lead counsel in numerous collective and class actions, including a 400-class member, $1.4 million case, an 80-class member, $1.375 million case, a $3.2 million case, a 469-class member, $225,000 case, and a 152-member, $236,500 case. More recently, David has served as a nationwide resource for small and midsize companies who have been sued for website violations of the Americans with Disabilities Act. He also has used his years of courtroom experience to vigorously represent individuals who have been significantly injured in motor vehicle and construction accidents. 


Mr. Stein began his legal career as an associate at the prestigious Philadelphia firm of Shrager, McDaid, Loftus, Flum & Spivey, one of the top litigation firms in Pennsylvania, principally representing claimants in massive multidistrict litigation in New York and Florida arising out of tainted blood products. Mr. Stein later founded his own law firm, where he litigated scores of criminal cases ranging from misdemeanors to death-eligible felonies. David later was a partner at the Coleman Law Firm, P.C., where he represented clients in leading-edge trademark and copyright litigation in the federal courts and in the Trademark Trial and Appeal Board (TTAB) as well as in domain name disputes before Internet Corporation for Assigned Names and Numbers (ICANN) tribunals. He subsequently co-founded the law firm of Samuel & Stein, where he was instrumental in developing the firm’s flourishing wage-and-hour practice and in solidifying the firm’s stellar reputation in the federal courts.


At STEIN & NIEPORENT LLP, Mr. Stein maintains a vibrant wage-and-hour practice focusing on class actions under the Fair Labor Standards Act (“FLSA”) and state labor laws. He currently has several pending class actions in the federal courts. David’s labor cases involve situations where employers have failed (1) to pay overtime compensation to their employees who work more than 40 hours per week, (2) to give a bonus to employees who work more than 10 hours in a given day, (3) to provide a salary in excess of the minimum wage, (4) to permit meal breaks, and (5) instances where employees have been fired or otherwise punished for complaining to their employers about not receiving overtime pay or the minimum wage. Mr. Stein also continues to handle serious personal injury cases.


David is a cum laude graduate of Brandeis University, George Mason University School of Law, and the Benjamin N. Cardozo School of Law, where he obtained an advanced law degree (LL.M.) in intellectual property with a concentration in the law of trademarks and copyrights. He is a past member of the Committee on Trademarks and Unfair Competition of the Association of the Bar of the City of New York.



Mr. Stein is admitted to practice in the Southern, Eastern, and Northern Districts of New York, the District of New Jersey, the Eastern District of Pennsylvania, the Eastern District of Michigan, and in the state courts of New York, New Jersey, Pennsylvania, the District of Columbia, and Illinois.
